Our Funds capability in Ireland
The team in Ireland is ranked in Chambers and legal 500 and can advise you on UCITS, AIFs and unregulated fund structures and distributing services globally. As part of an international Funds team, advice is provided seamlessly on a local and cross-jurisdictional basis on a wide range of fund structures and asset classes.
The Funds team in Ireland work closely with Irish funds on various industry and European submissions for each type of authorized fund, and provide thought leadership in respect of regulatory guidance, submissions as part of their industry work with the legal and regulatory, Fintech, tax, Brexit, depositary, digital assets, AML, ESG (including SFDR and the EU taxonomy) and other industry relevant working groups. The team also contribute to the Blockchain Ireland regulatory working groups on digital assets and smart contracts and separately to the Sustainable Finance Road Map for Ireland. Representative experience includes:
- advising in relation to complex regulatory and operational matters throughout funds settlement, distribution, valuation and custody cycle to include considerations of CSDR and CSD issues.
- on the launch of a wide range of UCITS and AIF products to include submissions to the Central Bank of Ireland as part of its pre-submission process in respect of commercial and residential property / real estate funds, loan origination, life settlement funds and ‘new and novel’ funds such as funds which invest directly and indirectly in digital assets and the enhanced scrutiny process related to certain categories of UCITS funds;
- on unregulated and regulated structures utilising special purpose vehicles, limited partnership arrangements and securitization structures;
- on change of service provider applications, re-domiciliation’s, UCITS mergers and amalgamations;
- AML, sanctions screening, technology related issues, governance and risk frameworks to include assistance with regulatory inspections; and
- on distribution, passporting, foreign registration and national private placement regimes, including Brexit related advice.
