The last few years have seen regular cycles of industrial action in the sector causing institutions to need to understand the complex legislation applying to the rights and obligations of collective employee relations and how they can best work with their trade unions.
The Employment Rights Act, which received Royal Assent on 18 December 2025, contains fundamental changes in relation to trade unions and industrial action which will impact on the way institutions engage with their unions. Many of these changes are due to come into force two months after Royal Assent, with others following in April and October 2026.
