Year on year, more employment tribunal claims are brought for disability discrimination than for any other protected characteristic. This reflects what we see in practice in acting for institutions, with claims for discrimination arising from disability and failure to make reasonable adjustments being particularly prevalent.
Requests for adjustments will be first be raised internally. So how should institutions deal with these fairly and minimise the risk of successful claims?
In this webinar we will cover:
- what is taken into account in deciding whether someone is disabled
- a reminder of the different types of discrimination which disability has in common with the other protected characteristics – direct, indirect, harassment and victimisation
- a focus on the disability specific ones – discrimination arising from disability and the duty to make reasonable adjustments
- types of adjustment – physical adjustments and equipment; non-physical adjustments – hours, location; the impact on performance and sickness absence management
- tricky issues – What is reasonable? Do you say “no” unless you have to say “yes”? Cost : how much is too much? Precedent : if you do it for one…? Maintaining adjustments : for how long?
This webinar is aimed at those working in the education sector.
