“Like Colorado’s law, SB21-169, the NY proposal would prohibit the use of lifestyle data and AI systems in underwriting and pricing if the use would unfairly and unlawfully discriminate against protected classes,” Mary Jane said. “It would require extensive proof of the lack of discrimination by testing that must be comprehensive and documented.”
